An operator may need to consult with a third party to seek approval for an access permit application. This is a requirement for some permits under s157 of the Heavy Vehicle National Law (HVNL).

Gazette notices, permits and some jurisdictional laws may require third parties and other entities to provide permission for a vehicle to travel if it exceeds certain mass or dimension limits.
Road managers may start their decision-making process, however, to ensure safety and infrastructure protection, we may not be able to issue your permit until evidence of third party approval has been provided.
Do I need third party approval?
It is your responsibility to consult and/or obtain consent with any third party providers that may impact your journey before travelling on the road network.
We must be satisfied that third party consent has been received and may request proof of this before issuing a permit.
If you require third party approval, you will need to obtain this prior to, or during, the application process.
Will the NHVR secure third party approval for my permit application?
No. Operators must secure all approvals from third parties such as electricity/utility companies, rail authorities and other third parties as part of their heavy vehicle operations.
You may also be required to provide evidence of these approvals:
- as part of the application process
- when the NHVR is advised by a road manager prior to permit issue
- as part of a condition on permit issue.
What triggers a third party approval requirement?
When a vehicle movement exceeds certain mass or dimension limits, third party providers may need to:
- be notified of the movement
- assess the proposed route for suitability of the movement
- provide approval (which may impose conditions) for the movement to occur, either over or under assets that they own (in most cases there is a legislated requirement for operators to seek this approval).
A combination can trigger the requirement for third party approval by exceeding mass or dimensions. One of the most common triggers is where the vehicle and load exceed a specified height.
Below are our requirements for managing applications where a vehicle and/or load exceeds a height of 4.3m.
NHVR height requirements
ACT, NSW, QLD, SA and TAS
- Over 4.3m but less than 5.0m in height - we don’t need to sight an approval prior to issuing the permit, however, a third party approval may be required prior to the vehicle and its load commencing travel.
- Over 5.0m in height - we are required to sight at least one approval prior to issuing a permit.
VIC
- Over 4.3m but less than 5.2m in height - we don’t need to sight an approval prior to issuing the permit, however, a third party approval may be required prior to the vehicle and its load commencing travel.
- Over 5.2m in height - we require a third party approval prior to issuing a permit.
Who is a third party entity?
Examples of third party entities include:
- Police – Oversize heavy vehicle movements may require police escorts and/or traffic diversion.
- Rail infrastructure managers – The movement of oversize or overmass heavy vehicles across level crossings/rail bridges or restricted access vehicles near rail infrastructure may create risks that need to be managed.
- Roadwork controllers – Heavy vehicle movements through worksites may need to be coordinated to ensure the site is free from obstructions.
- Tunnel operators – May need to be contacted to coordinate moves and ensure any special requirements are understood and complied with.
- Utilities – Restricted access vehicles may have adverse effects on utilities’ infrastructure with over-height vehicles and telecommunications/powerlines being a common concern.
